Your Contract is with Art Adventures Ltd referred to as “Art Adventures”.

A deposit of 10% is required at the time of booking, or full payment if booking is inside 30 days of departure, to secure your reservation.

All fares published supersede all prices previously advertised. Art Adventures reserves the right to cancel any ticket or booking or to refuse to carry any passenger where payment has not been received by Art Adventures within the specified time. Prices include New Zealand Government Goods and Services Tax (GST).

Art Adventures reserves the right to make changes to their itineraries or cancel any trip, including a guaranteed trip, at any time prior to departure if something beyond the control of Art Adventures deems it necessary, including natural disasters, political instability, terrorism, weather, cultural conditions or other external events. In this case Art Adventures will inform customers by phone and/or email.

If Art Adventures cancels a trip on which you are holding a fully paid booking you may choose between an alternative trip or a full refund. The company is not responsible for any incidental expenses that you may incur as a result of your booking such as visas, vaccinations, or non-refundable flights. If the alternative trip chosen is of a lower value than that originally booked then you are entitled to a refund of the price difference. If the alternative tour chosen is of a higher value, then you will need to pay the difference in price.



Please be aware that if you have booked through a third party like a travel agent, their cancellation policy and terms and conditions may differ to our own. Be sure to check their particular terms and conditions, including cancellation policy, as they will apply.

No refund will be made if you voluntarily leave a trip for any reason, this includes refund of accommodation, transport, sightseeing, activities, meals or services not utilised.

Age/Child Policy We do not accept any travellers under the age of thirteen. Any child aged between 13 and 16 is charged as an adult and must be accompanied by a full paying adult.

Local Partners Art Adventures works with highly reputable local specialist operators. These local partners are all passionate about the activities they operate and offer the same high standards as Art Adventures.

Important Information re Exclusion of Liability

1. Whilst Art Adventures will take all reasonable steps to provide an enjoyable tour, it accepts no liability for any loss of enjoyment experienced by passengers due to circumstances beyond its control. Art Adventures further accepts no liability for any loss beyond its reasonable control and provides no warranties in addition to those set out under the The Fair Trading Act 1986, and nothing herein restricts any passenger from exercising their rights and remedies pursuant to law.

2. If you are booking through a Travel Agent, she/he will forward booking confirmations and other payments to Art Adventures on your behalf, but your Travel Agent is not our agent for the purpose of receipt of monies. Receipt of booking confirmations and subsequent payments by the travel agent does not constitute receipt of those monies by Art Adventures and the Travel Agent has no authority expressed or implied to receive monies on our behalf. There is no liability on the part of Art Adventures in respect to any monies paid to the customer’s Travel Agent unless and until Art Adventures notifies the customer (by way of a booking confirmation advice or payment receipt advice) that monies have been received by Art Adventures.

3. The optional tour excursions and accommodation options are not operated by, or at the direction of, or on behalf of Art Adventures, its employees or agents or any other persons or companies associated with Art Adventures. All optional activities are an additional cost to the tour price and by taking bookings for these tours, Art Adventures acts as each optional tour operator’s agent.

4. These tours include the services of operators other than Art Adventures (e.g. hoteliers, tourist operations), which are not under the direct control of Art Adventures, and whilst Art Adventures takes all reasonable care in selecting these operators, it cannot accept responsibility for those operators’ conduct or the conduct of their representative employees or agents or for any ramifications of that conduct.

5. On the tours including transport and painting or sketching in remote locations, customers accept that degrees of risk are involved.

6. No customer will be permitted to embark or continue on tour while their mental or physical condition is, in the opinion of any representative of Art Adventures, such as to render them incapable of caring for themselves, or whereby they become objectionable to other passengers, or they become a hazard to themselves or other customers. Art Adventures will not be responsible for expenses resulting in such persons being precluded from completing the tour.

7. To the extent permitted by law, all our liability for damage to your property, disruption to travel plans, or mental injury is excluded. This exclusion is subject to any rights or remedies you may have under the Consumer Guarantees Act 1993.

Amendment Fees A charge of $25 NZD will apply to any change of tour departure requested after the original booking has been confirmed (except when change is due to Art Adventures cancelling a tour departure). If there is any change to the price of the tour you change your booking to, since the time of your original reservation, the new tour price will apply to the new reservation.

Itineraries Itineraries are subject to alteration without notice and intended as a guide only. Alterations may come about due to road or weather conditions, strikes, public holidays, local festivals and cultural or other reasons. Due to the nature of the terrain and remote areas, weather fluctuations can adversely affect road conditions that may necessitate alterations to itineraries with little or no notice. Any additional expense incurred by the passenger is not Art Adventures responsibility.

Minimum Numbers As is normally the case with group tours, a minimum number of bookings are required in order for a tour to be financially viable and to have a pleasant group atmosphere. In the event that adequate numbers cannot be achieved, it may be necessary to cancel a scheduled departure and to offer the nearest possible alternative date (or, of course, a full refund of monies paid). If an individual wants to have a private tour, a single person supplement is payable.

Customer Feedback If a problem occurs during your tour, then in your own best interests you should advise your Art Adventures Tour Driver immediately so that steps can be taken to resolve the matter there and then. If you remain dissatisfied, any complaint must be made in writing to us within 30 days.

Travel Insurance We strongly recommend passengers take out travel insurance to cover any unforeseen circumstances that may arise (including cancellation fees, medical and curtailment expenses, loss of luggage, early departure from tour due to death or illness). Your insurance should provide cover against personal accident, medical expenses, emergency repatriation and personal liability. We strongly recommend that you take out travel insurance at the time of booking. We suggest you ask your Travel Agent or consultant for more information.

Fitness and Medicals Some activities are strenuous in nature. Customers should be of reasonable health and fitness and carry all required medication. Art Adventures must be advised of any significant prior medical conditions at time of booking.

By engaging Art Adventures Limited to provide art tutoring and excursion services, you agree to the following terms and conditions.

Risk: You acknowledge that: there is some inherent risk in travelling to and from, and undertaking activities at, any location visited as part of the services; you must follow any safety instruction we provide; we will take all practicable steps to identify and minimise any potential risks or dangers but cannot absolutely guarantee your safety; our liability to you for any reason (including for personal injury, damage to your property, disruption to travel plans, or mental injury) is excluded to the maximum extent allowed by law.

Insurance: The accident compensation scheme that operates under New Zealand law means it is unlikely that you, or your executors, will be able to sue anyone if you are injured or die. In addition, the scheme provides limited (if any) assistance to visitors to New Zealand who are injured. If you are a visitor to New Zealand, we strongly recommend that you have full insurance covering any injury you might suffer.

Medical disclosure: Before the services start, you must let us know if you have any relevant medical conditions or requirements or any particular food allergies or requirements.

Medical release: You agree to us rendering first aid and seeking such medical assistance or means of evacuation as we may find necessary and you will pay all charges and accept all consequences that may be associated with such medical treatment or evacuation undertaken.

Bad weather and cancellations: Bad weather, safety concerns or other conditions beyond our control may require that we cancel or modify your excursion. We accept no responsibility for any loss or additional expenses arising from changes, delays or cancellations of the services.

Privacy and confidentiality: Your privacy and confidentiality is important to us. In the course of arranging and providing the services we may collect personal information about you. Your personal information will be used only to assist us in providing the services requested by you or to address complaints and resolve disputes. We will not release your personal information to any third party except where required by law, where you have authorised us to do so, or where disclosure is required for the purpose of the services provided.
